Terms of Service

1. Acceptance of Terms

By accessing or using the Nwoma mobile application ("App") and related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Nwoma is a digital reading platform that allows users to:

• Browse, purchase, and read digital books (eBooks)
• Create highlights, notes, and bookmarks
• Access AI-powered features such as summaries and recommendations
• Subscribe to premium features
• Interact with authors and other readers

3. User Accounts

3.1 Registration

To use certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Purchases and Payments

4.1 Book Purchases

When you purchase a book through our Services, you are granted a non-exclusive, non-transferable license to access and read that book through our App. You do not own the book; you are purchasing a license to access it.

4.2 Subscriptions

Premium and Pro subscriptions provide access to additional features. Subscriptions are billed on a recurring basis (monthly or annually) until cancelled. You may cancel your subscription at any time.

4.3 Refunds and Returns Policy

We offer refunds for digital book purchases under the following conditions:

• Eligibility Window: Within 7 days of purchase
• Reading Limit: You have not read more than 10% of the book
• Request Method: Contact infonwoma@gmail.com with your transaction reference

Refund Processing via Paystack:

• Refunds are processed through Paystack and typically take 3-12 working days to reflect in your account
• Mobile money refunds: 3-5 working days
• Card refunds: 5-12 working days depending on your bank
• Non-refundable components (platform fees, payment processing fees, Ghana taxes) will be deducted from the refund amount

Once you have read beyond 10% of a book, the purchase is considered final and non-refundable. Subscription renewals and wallet top-ups are non-refundable.

4.4 Payment Processing

Payments are processed securely through Paystack. By making a purchase, you agree to Paystack's terms of service. We do not store your full payment card details.

Wallet and Currency: Any wallet balances or tokens stored in your account are non-refundable and do not expire. All transactions are processed in Ghanaian Cedis (GHS) or other supported currencies as displayed in the app.

5. User Content

5.1 Your Content

You retain ownership of content you create (notes, highlights, reviews, comments). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our Services.

5.2 Prohibited Content

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights
• Contains malware or harmful code
• Is spam or unauthorized advertising
• Violates the privacy of others

6. Intellectual Property

6.1 Our Content

The App, its design, features, and content (excluding user content and third-party books) are owned by Nwoma and are protected by copyright, trademark, and other laws.

6.2 Book Content

Books available through our Services are owned by their respective authors and publishers. You may not copy, distribute, or create derivative works from book content except as permitted by applicable law (e.g., fair use for personal annotations).

7. AI Features

Our AI-powered features (summaries, recommendations, etc.) are provided for convenience and informational purposes only. AI-generated content may contain errors or inaccuracies. We do not guarantee the accuracy, completeness, or usefulness of AI-generated content.

AI Limitation of Liability: The AI assistant is a tool for comprehension; it is not a substitute for the actual book content. Nwoma is not responsible for any misleading or incorrect information generated by the AI. Users should always refer to the original book content for accurate information.

8. Prohibited Uses

You agree not to:

• Use the Services for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Scrape, crawl, or use automated means to access the Services
• Circumvent any digital rights management or access controls
• Share your account credentials with others
• Resell or redistribute purchased content

9. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Services will immediately cease. You may lose access to purchased content if your account is terminated for violation of these Terms.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NWOMA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or by email. Your continued use of the Services after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.
